The right real estate attorney is someone with a sharp eye who will help protect your rights. Your attorney will provide advice that helps you make smart and informed decisions. To ensure that the lawyer you hire is someone who will protect your rights while helping you navigate the legalities of real estate law, there are a few crucial things to keep in mind.


One of the most important steps in hiring a good real estate attorney is looking for someone with experience. Opt for an attorney who specializes in real estate law. Start your search online with the Bar Association for your state or the American Bar Association. There, you will be able to search for lawyers who practice real estate law. Your online search will also yield information about lawyers’ backgrounds, specialties, credentials and contact information.

Don’t hire the first real estate attorney you find in your area. Make a list of a few attorneys to interview. Ideally, you should interview them in person, but phone interviews work as well. Before scheduling an interview, be sure to find out if you will be charged for their time. Ask questions regarding their background and how much of their practice is dedicated to real estate law. Find out how many closings they perform per month on average, and ask for references. Find out up-front what fees you will face and if you will be charged at a flat or hourly rate. Discuss any potential conflicts of interest, such as associations between the attorney and local builders or real estate agents.

Be sure to choose a real estate attorney who can help you with all the services you need, and make sure he or she is experienced in dealing with special circumstances, such as short sales, foreclosure or eviction, if necessary. Many attorneys have paralegals. Find out if the attorney you choose has a paralegal and what his or her role will be. Ideally, you want to find a lawyer that fits your needs for budget as well as experience.
